This policy explains what information JC Software Foundry LLC (“we”, “us”) collects when you use JC Orbit AI at jcatlas.com (“Orbit”), how we use it, and the choices you have. If you have questions, email jcatlasus@gmail.com.

1. Information we collect

• Account information: your name (optional), email address, and a one-way hash of your password. We never store your actual password.
• Content you give Orbit: messages, photos and PDFs you attach, files you upload to your Files library, documents you add to document search, and voice recordings when you use the microphone.
• Content Orbit creates for you: answers, and files such as documents, spreadsheets and charts.
• Plan and usage: your plan, billing period, subscription status, and counts of messages and uploads used each month.
• Payment information: handled by Stripe. We receive your Stripe customer and subscription IDs and billing status — never your full card number.
• Messages to us: what you send through the contact form (name, email, topic, message).
• Technical information: IP address and basic request logs used for security, rate limiting and troubleshooting.

2. How we use information

• To provide Orbit: answer your questions, run the tools you use, and save chats and files on plans that include them.
• To run your account: sign-in, email verification, password resets, plan limits and billing.
• To keep Orbit safe: preventing abuse, fraud and misuse, and enforcing our limits.
• To reply when you contact us, and to send important service or billing messages.

We do not sell your personal information, share it for targeted advertising, or use your conversations to train AI models.

3. How AI processing works

Orbit uses OpenAI’s API to generate answers. When you send a message, its content (and any attachments, voice clip or document-search request) is sent to OpenAI to produce the response. Under OpenAI’s API data policy, API data is not used to train OpenAI’s models, and OpenAI may keep abuse-monitoring logs for up to 30 days. When web search is on, Orbit may send search queries to OpenAI’s web search tool. Messages are also checked by OpenAI’s moderation service to block harmful requests. AI answers can be wrong — please verify important information.

4. Service providers

We share information only with providers that help us run Orbit, and only for that purpose:

• Netlify — website hosting, serverless functions, storage of accounts, chats and files, and the contact form.
• OpenAI — AI answers, voice transcription and read-aloud, moderation, web search and document search.
• Stripe — payments, subscriptions and the billing portal.
• Resend — sending verification codes and password-reset emails.

We may also disclose information if required by law, to protect the rights and safety of our users or others, or as part of a merger or sale of our business (in which case this policy would continue to apply).

5. How long we keep information

• Account: until you delete it.
• Chats: saved until you delete them or your account — your 5 most recent chats on the Free plan and your 300 most recent on paid plans. Older chats beyond that limit are deleted automatically.
• Files library: until you delete the file or your account.
• Document search libraries: automatically deleted after 7 days without use.
• Python work files: expire at OpenAI after about 20 minutes; copies saved to your Files follow the Files rule above.
• Usage counts: kept per month to apply plan limits.
• Payment records: kept by Stripe and by us as required for tax and accounting.
• Contact messages: kept as long as needed to help you, then deleted.

6. Cookies and local storage

We use one essential sign-in cookie (kept for up to 30 days) so you stay signed in. Your browser’s local storage remembers settings like billing view and web-search preference. We don’t use advertising, analytics or cross-site tracking cookies.

7. Your choices and rights

• Access and correct: view and edit your profile on your account page.
• Delete: delete individual chats or files, clear all history, or delete your account from your account page. Deleting your account removes your profile, saved chats and files from our storage.
• Copy of your data: email us and we’ll send you a copy of the personal information we hold about you.
• Billing: manage or cancel your plan anytime from Manage billing.

Depending on where you live (for example California, Colorado, Virginia or other U.S. states), you may have additional rights to know, access, correct, delete or port your information and to opt out of sale or targeted advertising — we don’t sell or share data for advertising. To make a request, email jcatlasus@gmail.com or use the contact form (“Privacy request”). We’ll verify your request using your account email and won’t discriminate against you for exercising your rights.

8. Security

We use HTTPS everywhere, hashed passwords, signed HttpOnly session cookies, email verification, rate limiting and automated abuse checks, and our AI and payment keys stay on our servers. No system is perfectly secure, so please use a strong, unique password. See Privacy & security for details.

9. Children

Orbit isn’t intended for children under 13, and we don’t knowingly collect their information. If you’re 13 to 17, you need a parent or guardian’s permission to use Orbit. If you believe a child under 13 has created an account, contact us and we’ll delete it.

10. Where information is processed

Orbit is operated from the United States, and our providers process information in the U.S. and other countries. By using Orbit, you understand your information may be processed in the United States.

11. Changes to this policy

If we make important changes, we’ll update the date above and let account holders know by email or in Orbit before the changes take effect.

These Terms of Service (“Terms”) are an agreement between you and JC Software Foundry LLC, a Minnesota limited liability company (“JC Software Foundry”, “we”, “us”), covering your use of JC Orbit AI at jcatlas.com and related services (“Orbit”). By creating an account or using Orbit, you agree to these Terms, our Privacy policy and our Acceptable use policy. If you don’t agree, don’t use Orbit.

1. Who can use Orbit

You must be at least 13 years old. If you’re under 18, you need permission from a parent or guardian, who agrees to these Terms for you. If you use Orbit for a business, you confirm you’re allowed to accept these Terms on its behalf, and “you” includes that business.

2. Your account

• Give accurate information, including a real email address you can verify.
• Keep your password private. You’re responsible for activity on your account.
• One person per account. Don’t share, sell or transfer accounts. Team plans cover the number of users you pay for.
• Tell us right away at jcatlasus@gmail.com if you think your account has been accessed without permission.

3. Plans, limits and changes

Orbit offers a Free plan and paid plans (Starter, Pro, Engineer, Business and Teams). Each plan includes the features and monthly allowances shown on our Pricing page, such as messages, uploads and storage. Allowances reset on the 1st of each month and don’t roll over. Some features have fair-use limits to keep Orbit reliable for everyone. We may improve, change or remove features over time; if we make a change that materially reduces a paid plan you’ve already bought, we’ll tell you in advance and you can cancel.

4. Subscriptions, billing and automatic renewal

• Automatic renewal: paid plans renew automatically at the end of each billing period (monthly or yearly) at the then-current price until you cancel. By subscribing, you authorize us, through our payment processor Stripe, to charge your payment method each period.
• Prices and taxes: prices are in U.S. dollars. Applicable taxes may be added. We’ll give you at least 30 days’ notice by email before a price increase affects your renewal, and you can cancel before it takes effect.
• Teams: billed per user with a three-user minimum. Adding users updates your charges.
• Failed payments: if a payment fails, we may retry it and your plan may be paused or moved to Free until it’s resolved.
• Plan changes: upgrades, downgrades and seat changes are handled through Manage billing; Stripe may prorate charges.

5. Cancellation and refunds

• Cancel anytime from your account page, the Pricing page, or Manage billing — online, no phone call needed. Cancellation takes effect at the end of your current billing period. You keep paid features until then and won’t be charged again.
• Monthly plans: payments are non-refundable, and we don’t give refunds or credits for partial months or unused messages.
• Annual plans: if you cancel within 14 days of your first annual purchase or an annual renewal and have used fewer than 100 messages in that period, email us for a full refund. After that, annual payments are non-refundable.
• If Orbit has a significant outage or a billing error on our side, contact us and we’ll make it right.
• Where local law gives you more refund or cancellation rights, those rights apply.

6. Your content

“Your content” means what you put into Orbit (messages, photos, PDFs, documents, voice recordings and files) and what Orbit produces for you (answers and generated files). As between you and us, you own your content. You give us a limited permission to store, process and transmit your content only to operate Orbit for you — including sending it to our AI and service providers as described in our Privacy policy. We don’t use your content to train AI models. You’re responsible for having the rights to what you upload.

7. AI output — please read

• Orbit uses artificial intelligence. Answers can be inaccurate, incomplete, out of date, or look confident when wrong. Similar requests from other users may produce similar output.
• Always verify important information. Orbit is not a licensed engineer, electrician, accountant, lawyer, doctor or financial advisor, and its output is not professional advice. Before relying on calculations, circuit or wiring guidance, component ratings, safety information, pricing, tax, legal or medical content, confirm it with a qualified professional and the manufacturer’s specifications and applicable codes.
• You’re responsible for how you use Orbit’s output, including anything you build, install, sell or publish.
• Web search results and sources come from third-party websites we don’t control.

8. Acceptable use

You agree to follow our Acceptable use policy, which also includes the usage policies of our AI provider. We may block content, limit features, or suspend accounts that break it.

9. Our property

Orbit — its software, design, logo, name and branding — belongs to JC Software Foundry and is protected by law. These Terms give you a personal, non-exclusive, non-transferable right to use Orbit while your account is in good standing. Don’t copy, resell, reverse engineer or build a competing service from Orbit, or remove our notices. If you send us feedback or ideas, we may use them freely without owing you anything.

10. Third-party services

Orbit relies on providers such as OpenAI (AI), Stripe (payments), Netlify (hosting) and Resend (email). Their services have their own terms, and we’re not responsible for their availability or actions. Stripe’s terms apply to payments you make.

11. Suspension and termination

You can stop using Orbit and delete your account anytime (cancel any paid plan first). We may suspend or close your account, with notice when practical, if you break these Terms or the Acceptable use policy, don’t pay, create risk or legal exposure for us or others, or if we discontinue Orbit. If we discontinue Orbit or close your account without cause, we’ll refund the unused portion of any prepaid plan. After an account closes, we may delete its content as described in our Privacy policy, so download anything you need first.

12. Disclaimers

Orbit is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise Orbit will be uninterrupted, error-free or secure, or that its output will be correct or suitable for your purpose.

13. Limitation of liability

To the fullest extent the law allows, JC Software Foundry and its owners, employees and suppliers won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill, property damage or equipment damage, arising from your use of Orbit or reliance on its output — even if we were told they were possible. Our total liability for any claim relating to Orbit is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $100. Some places don’t allow certain limits, so some of these may not apply to you.

14. Indemnity

If you use Orbit for a business, you’ll defend and hold JC Software Foundry harmless from claims arising from your content, your use of Orbit’s output, or your violation of these Terms or the law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Before filing a claim, please email jcatlasus@gmail.com so we can try to resolve it informally within 30 days. Any lawsuit must be brought in the state or federal courts located in Minnesota, and you and we consent to their jurisdiction; either of us may bring qualifying claims in small-claims court. Nothing here limits rights you have under consumer-protection laws where you live.

16. Changes to these Terms

We may update these Terms. For material changes, we’ll email account holders or notify you in Orbit at least 14 days before they take effect. Continuing to use Orbit after that means you accept the updated Terms; if you don’t agree, cancel and stop using Orbit.

17. General

These Terms, the Privacy policy and the Acceptable use policy are the entire agreement between you and us about Orbit. If any part is found unenforceable, the rest stays in effect. Not enforcing a term isn’t a waiver. You can’t transfer these Terms without our consent; we may transfer them with our business. Neither of us is responsible for delays caused by events beyond reasonable control.

This policy is part of our Terms of service. It applies to everything you send to Orbit and everything you do with its output. Because Orbit is powered by OpenAI, you must also follow OpenAI’s usage policies.

Don’t use Orbit to:

• Break the law or help anyone else do so, including fraud, scams, and violating export, privacy or consumer-protection laws.
• Cause harm: weapons capable of mass harm, explosives, instructions for violence, promoting self-harm, or targeting critical infrastructure.
• Hack or attack systems: malware, exploits, credential theft, or unauthorized access to any system or account — including Orbit itself.
• Harm children in any way. Any content sexualizing minors is strictly prohibited and will be reported.
• Harass or exploit people: harassment, threats, hate, doxxing, stalking, non-consensual intimate content, or impersonating real people to deceive.
• Mislead at scale: spam, fake reviews, election or political disinformation, or passing off AI output as human-written where that’s required to be disclosed.
• Violate others’ rights: uploading content you don’t have rights to, infringing copyright or trademarks, or collecting other people’s personal data without permission.
• Make high-stakes decisions without a human: using Orbit alone to decide on someone’s employment, credit, housing, insurance, legal status or medical care.
• Treat output as certified work: presenting Orbit’s engineering, electrical, structural or safety output as stamped, certified or code-compliant without review by a qualified professional.

Don’t misuse the service

• Don’t get around plan limits, rate limits or safety systems, or create multiple accounts to avoid them.
• Don’t share, resell or automate access to your account, or scrape Orbit.
• Don’t try to extract Orbit’s internal instructions, keys or code, or probe for vulnerabilities (report them to jcatlasus@gmail.com instead).
• Don’t upload malware or files designed to harm Orbit or its users.

What happens if this policy is broken

Orbit automatically screens messages for harmful content and may refuse requests. If an account breaks this policy, we may block content, limit features, suspend or close the account without refund, and report illegal activity to the authorities.
